The ground rules.

These terms are the agreement between you and us when you use Twonight. The short version: be decent, your content stays yours, our work stays ours, and a free service can't carry unlimited promises. The full version follows.

1. The agreement

These Terms of Service ("Terms") are a binding agreement between you and Leaves & Marks LLC ("Twonight", "we", "us"). They cover the Twonight service: the Twonight apps and this website. By creating an account or using the service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service.

2. Eligibility

You must be at least 13 years old, or the higher minimum age your country's law requires, to use Twonight. By using the service you represent that you meet this requirement and that you are not barred from using the service under any applicable law.

3. Your account

• Sign-in is passwordless (Google, Apple, or an emailed code). You are responsible for keeping your email account and devices secure, and for everything that happens under your Twonight account.
• You must provide accurate information and keep it current.
• Your account is personal. Do not share it with anyone other than through the pairing features the app provides.
• You may delete your account at any time in Settings, at beta.twonight.app/delete-account, or by emailing us.

4. Couple pairing and shared data

Twonight is built for two. When you pair with a partner:

• Both partners can see and contribute to the shared movie world: watchlists, ratings, reviews, answers, and stats.
• Shared data belongs to the couple space, not to either individual alone.
• If you disconnect from a couple, shared data remains available to the remaining partner. Delete your account if you want your personal data removed.
• You may re-pair with the same or a different partner after disconnecting.

5. Your license to use Twonight

We grant you a personal, limited, revocable, non-exclusive, non-transferable license to use the service for your own non-commercial use, subject to these Terms. We reserve all rights not expressly granted.

6. Your content

You own the content you create on Twonight: reviews, notes, answers, ratings, suggestions. So that the service can work, you grant us a worldwide, royalty-free, non-exclusive license to host, store, display, and process that content, solely to operate, improve, and protect the service, including generating the AI-powered features described in the Privacy Policy. This license ends when your content is deleted, except where limited copies persist briefly in backups.

You are responsible for what you post. You agree not to submit content that is illegal, infringing, hateful, harassing, sexually exploitative, deceptive, or spam.

7. Community standards: zero tolerance

Some content on Twonight can be seen by people outside your couple, for example community questions and the ideas board. For that content we have zero tolerance for objectionable content and abusive users.

• You can report content from within the app or by emailing support@twonight.app.
• You can block users whose content you do not want to see.
• We act on reports within 24 hours by removing content that violates these Terms and ejecting the users who posted it.
• We may remove any content or suspend any account at our discretion to keep the service safe.

8. Acceptable use

You agree not to:

• Access or attempt to access other users' accounts or data;
• Use the service for any unlawful purpose;
• Probe, disrupt, overload, or interfere with the service or its infrastructure;
• Reverse-engineer, decompile, or extract source code, except where the law grants that right despite this clause;
• Scrape or automate access to the service without our written permission;
• Misrepresent your identity or affiliation.

9. Third-party content

Film metadata, artwork, and ratings come from third parties and remain subject to their terms. This product uses the TMDB API but is not endorsed or certified by TMDB. Streaming availability information is provided as a convenience and may be incomplete or out of date; confirm with the streaming service before you build your evening around it.

10. AI-generated content

Parts of the service (conversation prompts, recommendations, games) are generated by AI. AI output can be wrong, odd, or incomplete. It is provided for entertainment only and is not professional advice of any kind, including relationship counseling. You are responsible for how you use it.

11. Availability and changes to the service

Twonight is under active development. We may add, change, or remove features, and may suspend or discontinue parts of the service. Where a change materially reduces the service, we will give reasonable notice when practicable. We work hard to keep your data safe and available, but we cannot promise uninterrupted operation.

12. Fees

Twonight is currently free. We may introduce optional paid features in the future. If we do, prices and terms will be shown clearly before you pay anything, and no feature you already use will silently start charging you.

13. Our intellectual property

The service, including its software, design, branding, and content we create, belongs to Leaves & Marks LLC and its licensors and is protected by intellectual property laws. If you send us feedback or suggestions, you grant us the right to use them without restriction or compensation; we genuinely read them.

14. Copyright complaints

If you believe content on the service infringes your copyright, email support@twonight.app with the material's location, a description of the work infringed, your contact information, and a statement of good-faith belief. We respond to valid notices, including under the DMCA, and will remove infringing content.

15. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DATA WILL NEVER BE LOST. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.

16. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEAVES & MARKS LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF FIFTY US DOLLARS ($50) OR THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE. THIS LIMITATION DOES NOT EXCLUDE LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.

17. Indemnification

You agree to defend and hold harmless Leaves & Marks LLC from claims, damages, and reasonable legal fees arising from content you submit, your misuse of the service, or your violation of these Terms or of someone else's rights.

18. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Pennsylvania, USA, without regard to conflict-of-law rules. Before formal proceedings, you agree to try to resolve any dispute informally by emailing support@twonight.app; most issues are solved this way within 30 days.

If informal resolution fails, disputes will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, or, at your option, in small claims court. You and Twonight each waive the right to a jury trial and to participate in a class action. You may opt out of this arbitration clause by emailing us within 30 days of first accepting these Terms, and nothing in it removes rights that your local consumer law does not allow you to waive.

19. Apple App Store terms

If you use Twonight on an Apple device downloaded from the App Store, the following applies:

• These Terms are between you and Leaves & Marks LLC only, not Apple. Apple is not responsible for the app or its content.
• Your license is limited to use on Apple-branded devices you own or control, as permitted by the App Store Terms of Service.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation.
• Apple is not responsible for addressing claims relating to the app, including product liability, regulatory compliance, or consumer protection claims, or for third-party claims that the app infringes intellectual property rights.
• You represent that you are not located in a country subject to a US government embargo or designated as terrorist-supporting, and that you are not on any US government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

20. Google Play terms

If you downloaded Twonight from Google Play, your use of the app must also comply with the Google Play Terms of Service. These Terms are between you and Leaves & Marks LLC only; Google is not responsible for the app or its content.

21. Termination

You can stop using Twonight, or delete your account, at any time. We may suspend or terminate your account if you violate these Terms, if required by law, or if keeping it active creates risk for the service or other users. Sections that by their nature should survive termination (including 6, 13, and 15 through 18) survive it.

22. Changes to these terms

We may update these Terms. If a change is material, we will notify you in the app or by email before it takes effect, and update the date below. Continued use after the change means you accept the updated Terms.

23. Everything else

These Terms and the Privacy Policy are the entire agreement between you and us about the service. If any part is found unenforceable, the rest remains in effect. Our not enforcing a provision is not a waiver of it. You may not assign these Terms; we may assign them as part of a business transfer as described in the Privacy Policy. You agree to comply with applicable export laws.
